Und wenn die am Ende von B&G kommt - aber dazu muss es erstmal kommen!

Ich denke mal, das wäre eine Lösung, von der alle beteiligten profitieren könnten.
Weil wenn es wirklich zum äußersten kommen sollte, dass hier jemand die Keule schwingt (Forum unter dieser TLD nicht mehr zu erreichen, auch der letzte Depp hat kapiert dass er die Worte "UMC" bzw. "KDFI" und "MSextra" nicht in einem Satz schreiben darf...), dann weiß ich genau was passieren wird: Die Community wird sich anderweitig verlagern. Die, die Derivate nutzen werden sich über Art und Form ihrer Hardware ausschweigen und das ganze kocht im Verborgenen weiter. "Aus den Augen aus dem Sinn" wenn man so will. Wird es das momentane Problem (das ja offensichtlich niemand bestreitet) lösen? Nein.
Okay, der Bootloader der MS2 ist nicht verschlüsselt und die Software ist quelloffen. Wer will, der kann auch weiterhin auf einen leeren Chip von Farnell den MSextra Code flashen.
Aber ich denke Toolys Ansatz wäre gut. Damit könnten zumindest die, die entsprechend "Sportsgeist" besitzen durch Einbau von original CPUs auch belegen (und z.B. damit werben), dass es sich um lizenzierte Hardware handelt ("Lizensiert" im Sinne, dass das Copyright gewahrt bleibt). Ich vermute, davon würden beide Seiten profitieren? Okay, es könnte sein dass die Hersteller Support für ihre CPUs auf nicht originaler B&G Hardware ablehnen (so wie es ja jetzt auch ist). Das wäre dann ein anderes Thema...da muss man dann halt schauen was für ein Hersteller welchen Support leistet. Aber das ganze würde Transparenz schaffen.
Sagtmal...die originalen MS1 Prozessoren hatten doch immer so eine B&G Laser-Gravur, oder? Sowas in der Art ließe sich theoretisch doch sicher auch mit MS2 Chips bewerkstelligen?
Andere Hersteller von Elektronik-Komponenten handhaben es ähnlich (Verkauf von gekennzeichneten CPUs mit Bootloader vorinstalliert), und fahren meines Wissens recht gut damit.
Man könnte den Faden jetzt noch weiter spinnen mit fortlaufenden Seriennummern, die in einer Datenbank gespeichert werden usw usw. Möglichkeiten gäbe es da sicher viele.
Um sie zu nutzen, müssten sich nur alle beteiligten mal aufeinander zu bewegen.
Allerdings glaube ich nicht, dass es dazu kommen wird. Schade eigentlich...

genau so etwas meinte ich
ich denke auch das dadurch die meisten probleme gelöst wären
denn wie hier schon einige geschrieben haben geht es ja nicht darum das "wir" nicht gewillt sind lizenzgebühren zu zahlen
der einsatzbereich hat sich doch stark dahingehend verändert das kaum noch jemand einen vergaser-motor umbaut sondern vielmehr eine vorhandene einspritzanlage ersetzt um seinen einspritzzeiten etc. den modifizierungen anzupassen
das war auch der grund warum ich überhaupt angefangen hatte mein eigenes platinenlayout zu machen
ich hab das v3.0 board einfach nicht in mein vorhandenes gehäuse bekommen
und ich denke bzw. weiss das es vielen ähnlich geht

ja, ich denke mal, "hier in der alten welt" ist kaum einer gewillt eine hardware zu kaufen die er nicht brauchen kann. seis ob sie ins gehäuse passt, oder funktionen nicht direkt anbietet.
da wäre ein lizensierter chip ein guter weg. wobei man, je nach stückzahl auch einen eigenen aufdruck vom hersteller bekommen kann. wenn da zb groß B&G draufsteht wäre das fürs nachmachen schon eine hürde, alleine wegen den kosten

My answers to a few comments here:

Anti-German?
There is nothing xenophobic about my intentions. I think that a German speaking support forum for Megasquirt (i.e. actual Megasquirt) is a good thing. (I personally have done business in Europe although my French and German language skills are weak these days.)

I find it most strange that many replies here appear to be attempting to make me out to be the bad guy.

Imagine this situation. You walk into a shop and then take some product without paying. Outside you are stopped by a policeman. You then explain to him why it was in fact the shop-keeper's fault.

That is exactly how it feels to me.
Using the firmware without license is in breach of copyright - plain and simple. B&G are under no obligation to issue licenses. It is up to them to decide how they license their intellectual property. For the most part they also handle the licensing of my derivative works.

Saying "well I asked for a license" is almost irrelevant. Do you have a license or not?

Regarding ancient Megamanual comments.

Yes it is. How many other ECUs allow the users to discuss features with the firmware developers and allow end user modification of the firmware?
That does not in any way say that Megasquirt is "open source". That term has a very strict meaning which cannot be applied to Megasquirt.

However, whatever other comments may have been made in 2004 pre-date the MS2 firmware by a number of years and may or may not be valid.

I contacted Phil Ringwood about the quoted comments - he says he has no recollection, but that's irrelevant anyway - Phil is not a copyright holder on MS2.
For example, if I make a statement "Microsoft Office is now open source and you may install it for free on as many computers as you wish" -does that make it true? No it doesn't ! The same applies to Phil's quoted words, he does not speak for MS2 licensing and his words were incorrect.

Also, I realise that there is likely some language barrier to many non-English users. If it would be helpful to have a translation of the MS2/Extra license into German, I could work with one of my German friends to achieve this. pigga's earlier post looks pretty good though.

Oh and for the silly comment about taxes... I fully declare my earnings and pay UK tax.

Just this. A possibility to get processors with a pre-installed bootloader plus license could be an acceptable solution for everyone.

and now imagine this, the german law requires the owner to protect his property. if you don't you're at least partly to blame, if not fully, what we call "anstiftung zu einer straftat". don't know how this would be called in english, maybe "abetting a criminal offence" or so. i know that such a law doesn't exist in the USA because the police can park a car with running engine and wait for someone who steals it. would be highly illegal in Germany.

that depends. in Germay any private person has the right to copy for private use. i can legaly copy my bought music, movies, and even books. as long as i don't sell them or make hundreds of copies, or have to break copy protection. but i may give them to my brother or neighbour, too. so if i ever bought a MS1/2/3 i may copy the firmware from it, if it's not protected, and may transfer it to a similar processor for personal use.

yes, but if you can proof that the negoations with B&G finished with the promise their lawer will ship the contract it will make a difference regarding the obligation.

let's take a look. "open source" means the source code is available. i think this applies, does't it?
and after this fact, there comes the differences if you can modify the code for yourself (that apply, too?), or sell it (thats not allowed, if i'm right). and many more. but none of this changes something regarding the open source if the source code is readily available.
Office will never be open source untill the source code is readily available. even if Microsoft is giving it away for free, it's not open source, but just free software. and open source doesn't mean it's free.
i know that Philip Ringwood (you too, but you didn't reply) was contacted regarding MS1 extra, not MS2.

I really would prefer to talk about solutions instead of open source definitions.
Remember, we all are the Megasquirt community.

If we are not able to find something everyone can live with then we are not a community but a simple support forum here.

yeah, and if you look at other organisations, they have differend definitions. OSI names 10 points that needs fullfillment (funnily that the point with open source is number 2, not number 1. but that may be typically german to expect the most important first), other name less. but all have one in common, the source code has to be readily available, even if they don't agree in other points.
remember that this OSD/open sourse definitions are based on the need to make debian linux distributions free to everyone.
it doesn't make other or earlier definitions obsolet

James tell us how we could get a end user license for the companies which won't "buy" a license from you (which maybe want NOT become official dealers of MS).

What options have companies which use there own layout and want become a official dealer?
- end user pays to you until a selling break point and companies has to pay for new sells?
- companies have to pay you for all sales a fee - new and old.
- only new sales have to be payed? (Amnestie for old buyers)

Some guys also spend/donate some money which is more than the 2 or 4% - would that cover the end user fee you maybe want?

I think they reason why and how the thinking is in Europe/Germany we should discuss after that issue is solved.

Hi.
Yes, I must confess that some license agreement would be the best solution.
It's a strange situation (to my eyes): There are suppliers that offer a MS derivate. They are willing to pay license fees, but they can't. The reason is the "Copyright Contract" of the Megasquirt (c) (tm) (r) project that doesn't allow this.
If (sort of) licensing were possible, the MS staff could benefit from these sales with no additional efforts.
However, I do not see the willingness to liberate/change the Copyright/Licensing rules from James' or B&G side (or any other people that is involved into this project and participates from the copyright).
But...to be honest I can understand James a bit.
Imagine you have a look at the category "Erfolgsstorys / Ein-Umbaudokus" in this forum for the first time, you really read lots of stories about derivates...this might be shocking if you thought that Germany was a white dot on the MSextra Map until now.
@James: The main reason (to my eyes) is, that there is no official MS dealer in Germany. And (maybe more important) that MS stuff not perfectly meets the needs for typical applications in Germany (fitting the device in a stock ECU box and so on). I am quite sure that it's no criminal intention that leads most buyers to non-official Hardware.
So, legalizing this MS derivate would be the best solution.
What are the alternatives?
To my eyes:
Make the actual copyright "sticky" in the forum and (maybe) in the Wiki, including a German translation. This should at least make user aware that there is some copyright that (should) protect the interests of the developer.
In James' eyes (I suppose) it would be the best to ban/ignore/... all those users on megasquirt.de that are not using official MS hardware.
But I think this is hard to handle because this is a private forum with no commercial interests and it is not administrated by B&G. So there would just be the way to point out that this is no official Megasquirt (c) (tm) (r) forum and the administrators are in no direct commercial relationship to B&G and the whole MS developer staff.
This does not solve the main problem, but it could help to clarify the legal aspect of the MS stuff (i.e. that's not under GPL, that you only can buy a software license in combination with original B&G Hardware and so on).
Any ideas?

@James: Der Hauptgrund (aus meiner Sicht) ist, dass es keinen offiziellen MS Dealer in Deutschland gibt. Darüber hinaus (und vieleicht noch wichtiger) trifft das MS Zeugs nicht die Bedürfnisse der meisten Anwender in Deutschland (Einbau der Platine in eine Serien ECU und so weiter). Ich bin mir ziemlich sicher, dass keine kriminellen Absichten die Leute zum Kauf einer nicht-originalen Hardware leiten.
So gesehen wäre eine Legalisierung der MS Derivate die beste Lösung.
Was sind die Alternativen?
Aus meiner Sicht:
Das aktuelle Copyright "sticky" oben im Forum festtackern und (evtl.) ins Wiki aufnehmen, inklusive einer deutschen Übersetzung. Dies klärt die User zumindest schon mal darüber auf, dass es ein Copyright gibt, dass die Interessen der Entwickler schützt (bzw. schützen sollte).
Aus James' Sicht (vermute ich) wäre es das beste, auf Megasquirt.de alle User zu bannen/ignorieren/...., die keine offizielle MS Hardware nutzen.
Aber ich denke das ist schwierig umzusetzen, weil dies ein privat betriebenes Forum ist ohne kommerzielle Interessen, und es wird nicht administriert von B&G. So bliebe nur die Lösung dass man klar herausstellt, dies KEIN offizielles Megasquirt Forum ist und dass die Admins in keiner kommerziellen Verbindung zu B&G und der ganzen MS Entwicklermannschaft stehen.
Dies löst nicht das Hauptproblem, aber es könnte dabei helfen, die legalen Aspekte des MS Zeugs klarzustellen (d.h. dass es nicht der GNU Lizenz unterliegt, dass man eine SW Lizenz nur durch den Kauf der Hardware erwerben kann usw.)
Irgendwelche Ideen?

Without the clones Megasquirt wouldn't had such success in Europe.
Most don't want DIY look-a-like :)
